Terms of Use

These Terms of Use (the “Terms”) govern access to and use of ESG SaveEcoBot — its website, public pages, account area, information and analytics platform, data, API, integrations and other available system interfaces, including the interface for connecting AI clients.

By using the system, creating an account, paying for access or consenting to connect a separate interface, you confirm that you have read and accepted these Terms. If you do not agree with them, stop using the relevant service.

1. Who provides the service

The ESG SaveEcoBot information and analytics platform is provided by ТОВАРИСТВО З ОБМЕЖЕНОЮ ВІДПОВІДАЛЬНІСТЮ «СИСТЕМА ЕКОЛОГІЧНИХ ДАНИХ» (LIMITED LIABILITY COMPANY “ECOLOGICAL DATA SYSTEM”), EDRPOU code 45681049, registered address: 3 Viktora Nekrasova Street, Kyiv, 04136, Ukraine (the “Licensor” or “we”).

The platform is provided under the Public License Agreement for the right to use software products. Its current version is available here.

2. The system and its functionality

ESG SaveEcoBot is an information and analytics platform — a computer program and compilation of data made available remotely over the Internet. The platform provides information obtained from public sources, government registries, enterprise reporting and other datasets, subject to the available functionality.

Depending on the user’s access, plan and permissions, the user may receive data about enterprises, their addresses, permits, licenses, reports, documents, registries, inspections, ESG indicators and other related records. The available data and features may differ between plans and accounts.

Information in the system is provided for reference. It may be incomplete, contain technical errors or be updated with a delay because it depends on relevant government, public and other sources. The presence of a record in the system by itself does not confirm every circumstance, conclusion or legal status that may be inferred from it.

3. Account and access

Registration, authentication and, where required by the plan, payment of the license fee are required to use restricted features. Plan terms, access duration and available limits are defined on the selected plan page. Free or trial access may be provided on separate terms and may be discontinued.

The user must provide valid, accurate and complete information about themselves that is necessary for the system to operate and must keep their login and password secure. Do not share login details with third parties or enable access to the system for persons who do not have the relevant right.

Access may be provided through the website, account area, API, official integrations and other interfaces supported by the system. Additional authorization and access terms may apply to particular interfaces. The scope of access is always limited by the plan, the user’s permissions, connection settings and the current state of the system.

For connections to external clients, the user may grant a separate limited permission and later revoke it in the account area. Revocation of permission or termination of the plan terminates the corresponding access.

4. License, workplace and usage accounting

After accepting these Terms and meeting the payment conditions, the user receives a non-exclusive, non-transferable and limited, worldwide right to use ESG SaveEcoBot as a reference resource for their activities during the term of the selected plan. These Terms do not transfer ownership of the software, interface, design, data compilation or other intellectual-property objects to the user.

Under the Public License Agreement, one automated workplace means end-user computer equipment through which the user accesses the platform within one browser. One license may be used simultaneously from only one automated workplace unless the plan terms or a separate agreement with the Licensor expressly provide otherwise.

To monitor compliance with the one-automated-workplace condition, the system may check session activity and collect limited technical parameters of the browser and device, including through background heartbeat requests. Such data is used to control sessions and license restrictions, not to determine the content of the user’s activities outside the system.

Views of enterprises, pages and documents and other operations may be counted according to the plan rules. Actions through the API or other official interfaces may be counted under the same rules as corresponding actions in the browser account area. Viewing the same object again within the period defined by the plan may count as one view in accordance with the accounting rules.

5. Data, documents and responses from external services

We try to transmit system data without intentionally changing its meaning. However, an external client or AI model may shorten, rephrase, combine or incorrectly interpret the information it receives. A conclusion generated by an external service is not a verbatim response from ESG SaveEcoBot and may contain errors.

Verify important facts, documents and results directly against the system data and the relevant sources. Do not rely only on an automatically generated conclusion when making legal, financial, investment, environmental, safety, employment or other decisions with potentially significant consequences.

Documents available in the system may contain details that are not included in a short record description. They may be viewed or downloaded only within the granted access and in compliance with the law, the rights of owners and the rules for using the relevant document. After a document is transferred to an external client, its further storage, analysis and use are governed by that provider’s terms and privacy policy.

6. API and other machine-readable interfaces

APIs, published JSON endpoints, official integrations and other machine-readable interfaces are supported methods of accessing particular data and system features. Their use does not grant permission to copy the entire database, create a mirror of the platform or bypass plans, permissions, limits and technical restrictions.

A separate interface for AI clients that operates under the Model Context Protocol is an independent ESG SaveEcoBot interface and is not a mirror of the REST API. Its tools, response formats, available data and accounting rules may differ from the API. This interface may be used only through an official connection and within the granted rights, plan, limits and documentation.

Rules for using the API and other machine-readable interfaces may be updated. The user must use only the access methods supported by the system, comply with published restrictions and not create excessive load on the infrastructure.

7. Acceptable use

The user agrees to:

• use the system in accordance with the laws of Ukraine, these Terms and the Public License Agreement;
• provide accurate information necessary for registration, authentication and operation of the system;
• not access data, features or sections that are not authorized for the user;
• not bypass plan restrictions, permissions, limits, session controls or other protective measures;
• not create excessive load, send mass requests or collect data automatically outside the officially supported interfaces;
• not include system analytics data in other information or search systems and not distribute it without the Licensor’s permission;
• not copy the form or style in which system information is presented into their own information products without the Licensor’s permission;
• not decompile, reverse-engineer or create derivative products based on the system or its parts;
• not use the system for attacks, spam, fraud, unauthorized access or violation of the rights of others.

If these Terms or the Public License Agreement are violated, we may restrict or terminate access to the system and require the relevant use to stop. In the cases provided for by the agreement, the license may be terminated without a refund of the fee paid.

If an account or automated workplace shows unusually high activity that may indicate automated collection or processing of data in breach of these Terms, access may be temporarily blocked until the reasons for that activity are established. Other consequences of a violation, including those provided for by the Public License Agreement, apply in accordance with its terms.

8. Payment and access term

The license fee, access duration, feature set and limits are determined by the selected plan on the plans page. Payment confirms the granting of the relevant permission (license), unless a written agreement between the parties provides otherwise.

Online payments may be processed through WayForPay or another payment provider. The relevant provider’s terms and privacy policy may apply to the payment transaction.

Access ends when the plan term expires or may be terminated because of a violation of these Terms, the Public License Agreement or the law. Free access, promo codes and special offers may be discontinued under the terms on which they were provided.

9. Availability and changes

The system operates on an “as is” and “as available” basis. We may change, add, limit or discontinue individual features, data, response formats, sources and access methods. Access may be temporarily unavailable because of technical work, excessive load, interruptions in government or other external resources, network failures or other circumstances beyond our reasonable control.

We may update these Terms by publishing a new version on the website. Unless otherwise stated on the page, the new version takes effect when published. Continued use of the system after the changes take effect means that the user accepts the updated Terms.

10. Liability and limitation of liability

The Licensor is not responsible for the actual completeness, accuracy or timeliness of data obtained from government, public, official and other external sources, or for the inability to obtain information from such sources for reasons beyond the Licensor’s reasonable control.

The Licensor is not responsible for decisions, actions or omissions of the user or persons connected with the user that are made on the basis of system data or a conclusion from an external AI client, or for the operation, storage rules or data processing of external services after data has been transferred outside ESG SaveEcoBot.

To the extent permitted by law, the Licensor’s liability under this agreement is limited to the license fee paid for the relevant plan. This limitation does not apply to liability that cannot be limited under the laws of Ukraine.

11. Privacy and contacts

The procedure for obtaining, collecting, storing, using and protecting personal data is defined in the Privacy and Personal Data Protection Policy.

These Terms are governed by the laws of Ukraine. Disputes are resolved through negotiations and, if no agreement is reached, in accordance with the jurisdiction established by law.
